1. Agreement to Terms

By accessing or using Djify ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Djify is a web-based platform that provides tools for DJs to plan, analyze, and improve their performances. The Service includes features for set design, performance analytics, and creative development.

Djify is not a DJ player, streaming service, or music distribution platform. We do not provide or host music files.

3. User Accounts

Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may also delete your account at any time through your account settings.

4. Subscriptions and Payments

Free and Paid Plans

Djify offers both free and paid subscription plans. The features available to you depend on your subscription level. We reserve the right to modify, add, or remove features from any plan at any time.

Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the subscription fee.

Free Trials

We may offer free trials for paid plans. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to paid features until then.

Refunds

We offer a full refund within 7 days of your first payment if you are not satisfied with the Service. After this period, payments are non-refundable except as required by law.

5. User Content

Your Content

You retain ownership of any content you upload, import, or create using the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely to provide the Service to you.

Content Restrictions

You agree not to upload or share content that:

  • Infringes on intellectual property rights
  • Is illegal, harmful, or offensive
  • Contains malware or harmful code
  • Violates any applicable laws or regulations

Music Rights

You are responsible for ensuring you have the necessary rights to use any music metadata you import into the Service. Djify does not grant any rights to music or recordings.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Reverse engineer or attempt to extract source code
  • Use automated systems to access the Service without permission
  • Resell or redistribute the Service without authorization
  • Impersonate others or misrepresent your affiliation

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Djify and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Third-Party Services

The Service may integrate with or link to third-party services (such as Spotify, Rekordbox, Stripe, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content or practices of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DJIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Djify and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Djify operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
